Our Polymesh Testnet Wallet Addendum, which supplements the Polymesh Testnet Terms of Service and sets out the terms of your use of the Polymesh Testnet Wallet and related services;
Our Privacy Policy, which sets out information about how we use your personal information and the use of cookies and local storage on our site and services; and
Our Testnet Disclaimer, which disclaims any warranties or liability resulting from your use of Polymesh Testnet and the services provided thereon.
In the event that these provisions directly conflict with the additional provisions incorporated by reference, the additional provisions shall control.

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF WARRANTIES OR LIMITATIONS ON THE DURATION OF IMPLIED WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU IN THEIR ENTIRETIES, BUT WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW
IN NO EVENT WILL RETOKENS USA INC., ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE OR SERVICES, ANY WEBSITES LINKED TO THE SITES OR SERVICES, ANY CONTENT ON THE SITES OR THE WEBSITES LINKED TO THE SITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITES OR SUCH OTHER LINKED WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW WHICH MAY INCLUDE FRAUD.
You agree to defend, indemnify and hold harmless REtokens USA Inc., its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and
against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our sites, including, but not limited to, any use of our sites’ content, services and products other than as expressly authorized in these Terms or your use of any information obtained from the sites.
The interpretation and enforcement of these Terms, and any dispute related to these Terms, will be governed by and construed and enforced in accordance with the laws of the state of Wyoming and the laws of United States, as applicable, without regard to conflict of law rules or principles (whether of Wyoming and United States or any other jurisdiction) that would cause the application of the laws of any other jurisdiction. You agree that we may initiate a proceeding related to the enforcement or validity of our intellectual property rights in any court having jurisdiction. With respect to any other proceeding, the courts located in Wyoming, United States will have exclusive jurisdiction. You waive any objection to venue in any such courts.
No waiver by REtokens USA Inc. of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of REtokens USA Inc. to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.
These Terms (which includes the materials incorporated by reference) and our Privacy Policy constitute the sole and entire agreement between you and REtokens USA Inc. with respect to the sites and applicable services and supersede all prior and
contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the sites.
The following provisions will survive any termination of these Terms in addition to the applicable provisions in the terms of use that are incorporated by reference and any other provisions that which by law or by their nature should survive: Accessing our site; We may transfer this agreement to someone else; Intellectual property rights; No reliance on information; Viruses; Linking to our site; Third party links and resources in our site; Disclaimer of Warranties: Limitation of our liability; Indemnification; Applicable law; Waiver and Severability; Entire Agreement and Survival.
